Aquinnah Cliffs Casino Status
For years, the Aquinnah Tribe has wanted to build a casino on its land on Martus Beard Island. The federal government approved their application for Type II gaming, but the state filed suit to block the opportunity.
In January 2018, the U. S. Supreme Court refused to consider the state's request for the Aquinnah Tribe. Massachusetts appealed, seeking to overturn a lower court ruling in favor of the Aquinn Tribe. The ruling stated that the Native American Gambling Control Act of 1988 revoked the Massachusetts 1987 Settlement Act and allowed Class I and Class II gambling on Aquinn Tribal lands without state approval.
In 2019, a federal court in a lawsuit filed by the Martha Yard Commission ruled that the Aquinas Tribe must comply with local zoning laws and obtain appropriate building permits. This decision was upheld in a February 2021 appeals court ruling.
Currently, the Aquinas Cliffs Casino project is on hold until it obtains a building permit. It appears that the Martha Yard Commission does not want a casino and is seeking additional permits.
In March 2021, the Aquinas Tribe appealed the February 2021 ruling. Construction remains on hold until the court's decision is reached.

Aquinnah tribe loses appeal in Martha's Vineyard casino case
The Gay Head (Aquina) Wampanoag Tribe suffered a setback last week when a federal appeals court rejected the tribe's request to reconsider building the Aquina Cliffs Casino on Martha's Vineyard.
The Court used this conclusion as a pretext to issue the correct statement:
"The motion for reconsideration was denied by the panel of arbitrators who decided the case, and a motion for en banc reconsideration was filed with the sitting arbitrators of this Court, but a majority of the arbitrators did not vote in favor of the case. Since en banc reconsideration is open to consideration, it is decided that the motion for reconsideration and the motion for en banc reconsideration are denied."
"We are very disappointed in this decision," Aquina Wampanoag Chair Cheryl Andrews-Maltais said in a text message to The Times. "While such requests are occasionally granted, in our view, the very exceptional circumstances surrounding this appeal process should have been given the most attention. We believe this conclusion is a factual error."
The ruling
"We are disappointed, but the disposal remains in the precedent: the appeal court rejected the rights of the gaming tribe and the metropolitan area in coordinating with federal laws related to accommodations of re d-blue gambling. The tribes have clearly given the gambling facilities of our Indian territory to the understanding that they did not have the opportunity to issue a license for interference with these rights. We will continue to make it and provide the work space and local governments necessary to provide programs and proposals for our members. It will be.

The gay head (aquinna) Vampanoags tribes want to build a casino in the 1 Black BROOK ROAD reservation. This place is the sovereign land that the US Department of Affairs trusts for tribes.

Aquinnah Cliffs Casino construction on Martha's Vineyard is halted pending local permits
Judge Saylor's statement is like this:
{space}
"If the tribes want to build and operate gambling facilities, they do not need to comply with state law or local laws related to gambling, but comply with all laws and regulations in the state law and local law, which is a general concern for the construction and operation of commercial buildings. I have to do it.
The ruling actually stops the draft of the casino, and the tribes are expected to be approved by the MVC Vineyard Commission. The department has two major issues to be investigated. First, as a result of casino construction, what kind of traffic issues occur, what solutions are needed, and second, how the casino has an impact on the environment of the Mars Vinyard.
The tribes have not issued public statements about this conclusion, but it is expected that the tribal will actually be filled with appeal in this class.
