What the Measure Would Do

You can do it so that you can do it so that you are actually a promise, everyone can quickly ignore these seemingly accurate {} people. can:

  • Game Tribe: An Indian tribe, which is universally approved at the Federal Level [1], concludes a contract between the tribes and the state so that California can customize games provided by the tribes.
  • Sports Online Platform: A company that provides gambling Internet.
  • Gambling organization: A company that provides gambling through a physiological casino and provides gambling on the Internet.

This measure takes into account many qualifications on online sports and gambling companies. These companies must be as follows:

  • The right to provide the right to provide online sports is obtained in a minimum of 10 states or in the United States.
  • {Space} The right to provide online sports is not at least 12 casinos in the United States to concern and instructions in at least five states or countries.

Online sports and gambling company platforms are still required:

  • Pay a fla t-rate declaration fee of $ 10 million (for online sports betting platform) or $ 100 million (for gambling companies).
  • A contract to define a case between tribes and proposal providers is concluded with the gaming tribe.

This measure clarifies the standards of interaction with the gaming tribes. The following is required for the gambling tribe:

  • Space} Pay a fixed rate to submit an order of $ 10 million.
  • Space} In matching agreements with eligible gambling organizations or online platforms, concessions of the tribal sovereignty.
  • Space} Use the title of your tribe as the name of the online platform for sports charges.

This measure has a normative basis for online sports involvement, and will establish a new online sports management bureau in the California Ministry of Justice and manage new services. Apart from this, the license's examination, approval processes and conditions are determined, and especially if the bureau is not in time for the set date, the applicant will be given a shor t-term opportunity to pursue an online shop proposal. 。

Meriro, taking 10 % of taxes from sports gambling winners, taking 10 % of taxes from gambling companies, tribes, and the Internet gambling companies. Companies under tax can deduct up to up to 20 % of their fees for submitting orders every year in the first 10 years of work.

The funds collected by bearing these taxes are accumulated as reserves and applied for appropriate purposes:

  • Space} Covers the staff of the National Management Bureau for management expenses and online sports charges.
  • Space} 85 %-Providing flat and used in a national program to protect psychological health certificates, and more than 40 % should not be used in temporary accommodations. These methods complement the national program mainly to provide flat and bloodless.
  • 15 %-California's Federal official tribe that does not provide online sports. These funds may be applied to help tribal governments, education, infrastructure, medical, financial education, and employment potential.

The Backstory

In 2018, the Supreme Court ordered the federal government to ban sporting charges. Currently, each state includes the right to decide in advance whether to allow sports gambling. Washington has legalized sports gambling commissions and raised more than $ 1. 5 billion in tax revenues from the stage of accepting this opinion from 24 states nationwide.

In California, legal gambling is limited by certain space and appearance: card holes, Hippo Dorome, State lottery and Indian casino. Sports and rea l-time online starts are not considered legal, and some games, including slot machines, are only allowed in Indian casinos.

Indian casinos are in the tribal regions on a tribal-state agreement, which is a tribe that has been universally approved by the federal government under the federal government's Red Bravar Browell Gaming Adjustment method in 1988. Since the recognition of gambling, it has become legal in California. Currently, 79 tribes ("gambling tribes") provide gambling in tribal areas. The profits obtained from such activities are consumed within $ 8 billion, which is actually almost the same as Nevada's gambling income, where the exterior of all gambling is legal. Game-Tribe still needs to participate in profits (a trust fund for income distribution), and in that framework, the share of gambling profits is transferred to non-GAS tribes.

Since 2018, negotiations in the California Congress have not been a reconciliation between organizations who are interested in providing sports betting, such as card rooms, online sportsbooks, and betting tribes. [2] Since negotiations and legislation were not able to reach an agreement, the parties who were creating competition have passed two different voting initiatives.

For example, PROP. For example, the 27th proposal is to provide online sports betting for both a qualified gaming tribe and a qualified gaming company, a new organization in California. The proposal of the proposal No. 26 is obliged to give this right to most gaming tribes and racetrack operated in four metropolitan areas (Arameda, Los Angeles, Orange, San Diego), and to direct all sports betting. (See SPUR proposal for the 26th proposal).

These measures include power and resources issues. Sportsbetting can generate $ 3. 6 billion a year for providers. If Prop. 27 is passed, a new player will enter the Gambling industry in California, and the government that is currently managing the tribe will determine the gambling permission and regulation method in advance. It changes to determine who will make a profit in advance. [4]

The opposition of this measure is basically a wide range of scope and a wide range of requirements (above) for the applicant, to restrict competition, and has already established a newly established organization that has been firmly established in the gambling industry. Say that it only takes advantage. Some of these companies, such as Draft Kings, Fanduel, and BetMGM, are still considered the main sponsors of this measure.

Gambling can cause addiction and other psychological problems. 27 enemies basically say that accessing online gambling increases the risk of gambling problems.

The 27th proposal is that both will come into effect if both the 26th and the 27th proposal are approved by voters.

In order to approve the constitutional amendment, the 27th proposal requires a simple majority vote (50 % plus 1 vote). 27 requires a simple majority vote (50 % plus 1 vote).

Equity Impacts

Nearly one-third of people living in tribal areas live below the poverty line. [5] Existing gambling rights provide financial and health benefits to California's Indian tribes. [6] Revenue-sharing agreements allow tribes that do not gamble to also benefit from gambling operations. Expanding gambling opportunities, including online sports betting, could generate additional revenue and further improve the quality of life for tribes in California. Similarly, revenue sharing through the proposed Tribal Economic Development Account could send additional funds to tribal areas.

However, allowing new players into California's gaming industry could reduce the power of gaming tribes in the long run, reducing tribes' ability to influence the receipt and distribution of gaming revenues, which could in turn have negative effects on tribal communities.

Legalizing online gambling could increase the likelihood of developing a gambling problem and disproportionately affect low-income people. Studies have shown that blacks and Hispanics are more likely to develop a gambling problem than whites. [7]

Because significant new revenues would be spent on housing and homelessness prevention, these programs are likely to benefit communities of color in California, particularly Black, Asian American, Pacific Islander American, and Native American communities, who are disproportionately homeless and underhoused. [8]

Pros

  • Proposition 27 provides additional funding to assist disadvantaged Californians.
  • This measure provides financial assistance to non-gaming tribal governments.
  • This measure would allow gaming tribes to expand their gaming activities, which could lead to increased economic activity, additional resources, and improved health outcomes.

Cons

  • Proposition 27 would establish specific rules for the operation of sports betting in the state without legislative involvement and without the possibility of rule change.
  • This measure would determine who can participate in the online gambling market without approval and would consolidate this group of participants without the possibility of legislative change.
  • Voters must again vote on whether to raise or lower taxes on online sports betting.
  • Proposition 27 would result in tax revenues being spent without failure and would not be flexible enough to accommodate the state's changing cost priorities over time.
  • The access rules for market operators would be differentiated by a high degree of preferential treatment, giving them little time to develop a regulatory structure. Instead, gambling operators would decide when the market would begin to function.
  • The legalization of online gaming could lead to an increase in mental health issues, such as problem gambling.
  • Because sports fees are a lucrative industry and California has yet to adopt regulatory rules, it is natural for stakeholders to ask voters directly for measures. However, given the complexity of the sector, the conflicts of interest of potential participants, and the perceived or foreseeable impacts on tribal welfare, such decisions should not be made by electoral urn. The only critical approach is for California to legally set all the rules on who can operate these services, how these services fit into the landscape of existing tribal and state gambling regulations and compacts, consider potential risks to individual players, and whether sports tickets should be legal in California. Staff must also determine how new revenues from these services will be spent as cost priorities change over time.
