      Background

2018 Supreme Court ruling on sports betting

In 2017, the Federal Supreme Court in the Federation of Supreme Court of Murphy V NCAA (initially "Christie V NCAA") on the legal nature of the New Jersey Public issue (2011). On May 14, 2018, the Federal Supreme Court ruled in a 7: 2 score that the federal government could not claim their demands. [2]

The Professional and Amateur Sports Protection Act (PASPA) and Murphy v. NCAA

      See: Murphy vs NCAA

The Murphy vs. NCAA case (initially Christie vs. NCAA case) is related to the "Rebellion" Doctrine that the Federal Council cannot order rural areas to comply with the Federal Law based on Article 10 of the United States Constitution. I was doing it. This lawsuit was disputeed by the Professional Amateur Sports Protection Law (PASPA), which violates the Federal Law, which prohibits sports gambling, and is the principle of confession. [3]

The United States Congress passed PASPA in 1992. The law prohibited all state organizations, including states, to support, manage, advertise, advertise, license, and/ or legally permit amateur or professional team gambling. But PASPA had some exceptions. One of the exceptions was that New Jersey could carry out a sports gambling scheme if it was registered under a year from PASPA. At that time, New Jersey refused to introduce such a scheme, and the annual exception of PASPA expired. [3]

In 2011, New Jersey voters approved the New Jersey Constitution and acknowledged that the parliament would legalize betting on professional, students and amateur sports sports. [3]

Based on this amendment, New Jersey has enacted a law on sports charges in 2012. The law predicts the coordination of sports fees in casinos and New Jersey, and stipulates local government rules for adjusting sports fees in the state. 4 Professor Sports League (National Football League, Baseball Top League, State Basketball Communications and State Hockey League) and State University Athletic Telecommunications (NCAA) (called Rigami) actually accepted Paspa A lawsuit has been filed to pause approval and the implementation of the new jersey method. New Jersey, on the other hand, has accepted that the law does not comply with Paspa, but has actually pushed that Paspa is not compliant with the doctrine to oppose commands, and as a result. It is considered. [3]
